TOPIC: “First Day Cash Collateral and Financing Motions: How the Judge Evaluates Them and Approaches Grey Areas.”

So-called 'first day' motions in bankruptcy cases often involve the debtor's request for authority to borrow money or use cash collateral. The Federal Rules of Bankruptcy Procedure - recently amended - and the local Guidelines for Cash Collateral and Financing Motions and Stipulations govern what the court will normally approve or disapprove. This program will be both a refresher on the Rules and Guidelines and an explanation of how the court approaches requests to depart from the Guidelines.

TOPIC: Responding to the Mortgage Crisis: HUD’s Proposed RESPA Rule and Other Federal Responses

Michael C. Flynn, General Deputy General Counsel from U.S. Department of Housing and Urban Development. Mr. Flynn will focus on federal responses to the perceived mortgage crisis. Mr. Flynn will discuss HUD’s new proposed RESPA rule and other proposed federal initiatives. Since February 2007, Mr. Flynn has been the General Deputy General Counsel of HUD in Washington, DC. Prior to that time he was Senior Vice President and Senior Counsel at World Savings Bank in Oakland, California and General Litigation Counsel for Chicago Title Insurance Co. in Chicago, Illinois
